In 2007 it will be time once again to utilize the Democratic process and elect the officials of this Union. Elections will be conducted for all your representatives. IT IS EXTREMELY IMPORTANT THAT HEADQUARTERS HAS AN ACCURATE ADDRESS FOR EACH AND EVERY MEMBER. ALL BALLOTING WILL BE CONDUCTED BY MAIL. IF YOU HAVE RECENTLY MOVED, OR HAVE NOT RECEIVED UNION MAIL, PLEASE CONTACT YOUR STEWARD OR HEADQUARTERS FOR VERIFICATION OF YOUR ADDRESS.

This bulletin is to adhere to our Local Union 827 Bylaws giving the membership 20 days prior to the first meeting of nominations.

Chief Steward, Steward and Alternate Steward postings will be conducted on January 5, 2007. Candidates for any of these positions must signify their intention in writing, by US MAIL to P.O. Box 1509, E. Windsor, NJ 08520; within 10 days and no later than 5:00 PM of the last day of the posting, January 17, 2007. Instructions will be included on the posting. Candidates must signify how they want their name to appear on the ballot in the nomination letter. Nomination letters received by the Unit Election Officer will be forwarded to Headquarters and ballots will be formulated and mailed from Headquarters. Instructions will be included with the ballot. It is mandatory that the election committee receives a nomination letter for each voting section, even if a member runs unopposed.

During the month of January there are meetings scheduled for each Unit where nominations will be accepted for: President/Business Manager/Financial Secretary; Vice President; Recording Secretary; Treasurer; Executive Board/Business Agent; Unit Chairman, Unit Vice Chairman and Unit Recorder.

Following are the specifics for these meetings:

Guidelines for these meetings have been formulated and approved by the Executive Board. Copies of the guidelines will be available at each meeting. Nominations will be accepted from the floor. A second on the nomination is not necessary. The Nominees will then be given the opportunity to address the membership followed by a question and answer period. After each Unit meeting is concluded a list of nominees will be forwarded to Headquarters. Ballots will be prepared and sent to the members of that Unit, by Headquarters, for any Unit Office position in contention. Instructions will be included with the ballot.

To allow all qualified nominees for Local Union (Statewide) Office the opportunity of expression, a special election edition of the New Jersey Reporter will also be printed. IF A NOMINEE FOR LOCAL UNION (STATEWIDE) OFFICE WISHES TO HAVE AN ARTICLE IN THIS SPECIAL EDITION THEY SHOULD SUBMIT IT TO THE STATEWIDE ELECTION CHAIRPERSON (JASON A. D'ERRICO) AS SOON AS POSSIBLE AFTER BECOMING A NOMINEE BUT NO LATER THAN 12:00 PM ON JANUARY 31, 2007. It shall not be longer than 600 words. All submissions can be e-mailed to ibew827elections@aol.com or can be saved to a 3.5 disk or cd with the file being typed in Microsoft Word and typed in both upper and lower case. Articles typed in all capital letters are unusable and will be returned. Articles should not be faxed and no laser prints are going to be accepted as in previous years. The article will not be checked for grammatical or spelling errors. A clear headshot photo may also be submitted for publication. The publisher will mail the special edition to the membership as soon as it's completed. If all articles are submitted early enough, the special edition could be in the hands of the membership at the same time as the ballots are mailed from the AAA. This special edition election issue of the NJ Reporter is for factual background information only. It will not be used for political bashing, future promises or past issues with the union. The cooperation of each candidate is extremely important. ARTICLES SUBMITTED AFTER 12:00 PM on JANUARY 31, 2007 WILL NOT BE INCLUDED FOR PUBLICATION IN THE SPECIAL EDITION.

Local 827 will also honor any reasonable request to distribute campaign literature to members at the requestor's expense. Campaign literature will be distributed by ABCO Publishing. There are various versions of mailings that can be executed through ABCO Publishing so I will not publish all pricing at this time. A letter will be handed to all Candidates for Local Union Office at the nomination meetings conducted in January 2007 by your Statewide Election Chairperson Jason A. D'Errico.

When all six Unit meetings have been concluded, a list of nominees for the Local Union (Statewide) Offices will be obtained by the Election Board from Headquarters. The Election Board shall instruct the American Arbitration Association (AAA) to have ballots prepared and sent to the membership. Ballots cast shall be mailed back to the AAA in the pre-addressed return envelope provided. Instructions will be included with the ballots. PLEASE FOLLOW THE INSTRUCTIONS CAREFULLY. The AAA shall count the ballots and certify the results to the Election Board.

Following are the specifics for the Local Union Officer elections:

In the event a candidate does not receive a majority of the votes cast for a specific Local Union (Statewide) Office, then a run-off election will be held between the two candidates receiving the highest number of votes. Following are the specifics for the run-off election (if necessary) which will also be conducted by the AAA:

March 13, 2007 Ballots will be mailed by the AAA.

March 28, 2007 Last day of receipt by the AAA for ballots cast

March 29, 2007 9:00AM Ballot count at Holiday Inn (location same as above)

Candidates have the right to IBEW member observers at the tallying of the ballots.

As you can now realize, the need for Headquarters to have an accurate address for each member is of the utmost importance. If there are elections for each position you may receive up to five ballots; 1. Steward and Alternate Steward 2. Chief Steward 3. Unit Chairman, Vice Chairman, Unit Recorder 4. Local Union Offices of Executive Board/Business Agent, Recording Secretary, Treasurer, Vice President, President/Business Manager/Financial Secretary 5. (If necessary) Run-off for Local Union Offices.

There will be instructions with each ballot. Please follow them carefully. The ballots sent from Headquarters will be color-coded. Please return the proper ballot in the proper pre-addressed return envelope. The secrecy of all members' votes will be maintained, if you follow the instructions that are printed on the ballots you receive.

REQUESTS FOR THE RE-MAILING OF DUPLICATE BALLOTS CAN ONLY BE COORDINATED THROUGH HEADQUARTERS BY THE UNIT ELECTION OFFICER.

If you did not receive a ballot within the timelines expressed above, it is extremely important that you contact your Unit Election Officer or Statewide Election Chairperson as soon as possible after becoming aware of an election that you should have received a ballot for.

NOTICE
Motions are pending which, if passed, would amend the Bylaws to incorporate the following changes:

1. The following percentages of top classification of the majority employer Local 827 represents shall apply when computing the salaries of elected Officers:
165% - President/Business Manager/Financial Secretary
155% - Vice President
140% - Executive Board/Business Agent
25% - Recording Secretary
25% - Treasurer

2. Change Treasurer to part time.

3. Use a weekly salary of 40 hours of the top classification of the majority employer Local 827 represents for 401K matching purposes.

There is no guarantee that salary/benefits of elected Officers will remain as they are in the current Bylaws.

Dear Union Member and Family,

On Tuesday, November 7th, voters across New Jersey will go to the polls to select a candidate who will represent our state in the U.S. Senate for the next 6 years. The issues that the successful candidate will face while representing us in our nation's capital are critical to working families and it is essential that our voices are heard. With less than one month until we go to the ballot box, now is the time to make up our minds and decide which candidate holds our working family values.

Bob Menendez has consistently worked to create and protect good paying jobs. He fought to protect our jobs from going overseas and against the Central American Free Trade Agreement. He co-sponsored the Trade Adjustment Assistance Improvement Act to extend TAA coverage to service sector workers whose jobs have been outsourced and co-sponsored the Rail Worker Emergency Training Act to offer emergency-response training programs for rail workers. Bob Menendez introduced a bill to allow hard working Americans that are between jobs a refundable tax credit for 50% of the premium for continuation of coverage under a group health plan. He consistently advocates to increase the minimum wage.

Tom Kean, Jr. voted against saving American jobs by not banning the outsourcing of State funded service contracts and denied unemployment insurance benefits to locked-out workers. He voted against raising New Jersey's minimum wage.

How you vote is a personal decision and we encourage you to review both candidates' records. Your union and the New Jersey State AFL-CIO have endorsed United States Senator Bob Menendez and believe that he is the best candidate to keep fighting to protect our jobs. However you decide, please vote on Tuesday, November 7th.

Dear Union Member and Family,

I am writing to you about the upcoming elections. This November, we have a choice. We have the opportunity to elect candidates that will fight for working families, or, we could simply choose to encounter the same old unfriendly "business as usual" practice that dominates both Washington, D.C. and Harrisburg. We can, and must, take action.

This is a special year, as one of our own is running for Congress in the 15th Congressional District. Charles Dertinger, a third-generation IBEW Local 3 member and Northampton County Council Member, is running for Congress to fight for working families. Charles Dertinger understands our issues, and will serve the 15th District well as our next Congressman.

As you are aware, working families have come under increased pressure; energy costs are increasing, jobs are continually shipped overseas and the cost of health care is skyrocketing. Bob Casey, our State Treasurer, is running for U.S. Senate to fight for working families and combat this trend. In Bob Casey, we will get a Senator who will look after every Pennsylvanian and protect good jobs and wages.

Since taking office, Governor Rendell has fought for working families. He has created over 120,000 new jobs in Pennsylvania and fought successfully to increase the minimum wage. Ed Rendell is on our side, and is a strong voice for working families.

Enclosed you will find some information on each of the candidates that I mentioned. Please take some time to consider them. How you vote is your own decision, but please keep in mind the stakes that are involved this election. We have the ability to change the direction of this country right here in Pennsylvania with the election of Charles Dertinger to Congress, Bob Casey to the U.S. Senate and the re-election of Governor Ed Rendell.

LOCAL 827 PETER J. CASEY SCHOLARSHIP FOR 2006-2007

It is time once again to call for a scholarship application for your son/daughter in his or her senior year of High School.

1. All applications must be received at Local 827 Union Headquarters by January 31, 2007.
2. Each scholarship is for $1,000.00, and will be awarded to two (2) students per Unit.
3. For scholarship applications, please call Local Union Headquarters at (609) 443-4100.
4. All applications received are forwarded to Rutgers University for consideration. The Office of University Undergraduate Admissions Committee makes the selections.
In addition, IBEW offers other Scholarships:
· An IBEW Founder's Scholarship for IBEW members only (this does not include spouses or children). This scholarship is for IBEW members who have been in continuous good standing for the four years proceeding May 1st of the scholarship year. You can visit the IBEW web site (www.ibew.org) for more information and a printable application.
· A Union Plus Scholarship for IBEW members, as well as member's spouses and dependent children. The Union Plus Scholarship application can be accessed online at www.unionplus.org.
Applications for these Scholarships are also available in Union Headquarters.

Dear Member:

As you may recall I sent you a letter on February 22, 2006 advising you that I had cancelled the vote for the Bylaw changes and the reasons why. I also explained in that letter that I requested guidance from the International Office. An independent auditor was assigned from "Calibre CPA Group" to review our books and procedures. Several weeks ago I received a letter from International President Edwin Hill advising us of the auditors findings. In short the audit confirmed that there were no misappropriation of funds but changes need to be made to insure our financial viability.

On July 31, 2006 I called a special Executive Board Meeting to address the auditors findings and to move forward on a cost saving financial plan for the future. The Executive Board voted by a five (5) to two (2) vote to move forward on the Bylaw changes that were discussed and voted on at their Financial Meetings. These Bylaw changes include the reduction from 6 units to 4 and other cost cutting measures, which were discussed and approved at Financial Meetings by the Executive Board. We also need to change some procedures on time reporting and approval of expenses to make it easier to comply with Department of Labor regulations. I have asked the accounting firm of Calibre to help us put together some more stringent guidelines on these issues.

I have instructed the Executive Board that the Bylaw changes are to be read at the August General Membership Meetings and voted on at the September General Membership Meeting. All changes, if approved by the membership, will take affect at the beginning of the next term of elected officials, which is April of 2007. If these structural changes are not approved prior to the next election we will have to wait three more years to make these changes, which in turn will put a greater financial burden on the local.

As I said in my previous letter, the membership, through a survey, voted by a count of 2092 to 296 in favor of restructuring instead of a dues increase. Please don't let self serving political agendas influence you in doing the right thing. I strongly support what the Executive Board has recommended and I hope you will vote to support these changes in September to start on a concrete path to financial viability for the future of our local.

Below is the scheduled General Membership Meetings. You must attend one of these meetings in order to vote. Once again I remind you that we are at a major crossroad and these decisions are not easy. Please don't let a few selfish individuals attempt to derail this vote once again with false accusations and lies.

As described in the 2003 Collective Bargaining Agreement a 2% wage increase is scheduled to take affect on August 6, 2006. This year is the first year that the negotiated Cost Of Living Allowance would take affect if the "CPI-W" exceeds 4%. The Cost Of Living Adjustment for this year is 1.66%. This equates to a total wage increase of 3.66%.

On Friday April 21, 2006 the IBEW and CWA met jointly with Verizon under the terms negotiated in 2003.

Our discussion on wages revolved around the increase in the Cost Of Living allowance negotiated in 2003. The final numbers will not be in until sometime in June. As of March, the Cost Of Living increase would be .87%. This number will probably change and the estimated amount of the increase should be between .75% and 1% added to the negotiated increase of 2%. Once we receive the final CPI-W numbers sometime in June we will notify you.

On the issue of job security our discussions revolved around the Verizon/MCI merger and their creation of a separate entity called Verizon Business. The Company refuses to put this work into our bargaining units, and insists that this will be a separate entity which they want union free. It is our contention that this is bargaining unit work. The New Verizon Business Unit currently operates with non-union employees or sub contractors.

They have informed us that customers with an annual billing of over $250,000.00 will all be Verizon Business customers. We cannot allow this to happen. It will impact our enterprise work throughout the state. If you see anyone in our plant or at customer premises that is not a Local 827 member please get as much information as you can and forward it to your Business Agent.

We are currently waiting for information which we requested at the national level and will continue meeting with the IBEW and CWA international unions. We are committed to do whatever needs to be done to resolve this issue. Thank you for your help in preserving our jobs!

As you may be aware the Company attempted to implement a new absence plan effective May1, 2006. We have demanded bargaining which began on April 27 with more dates scheduled. The Company cannot implement this new plan until bargaining is complete.

From: JASON A. D'ERRICO, STATEWIDE ELECTION CHAIRPERSON

The Constitution provides that the IBEW shall meet in regular convention every five (5) years. The International Convention is the highest governing body of the IBEW. It elects all International Officers and determines the basic law of the IBEW by its votes on proposed resolutions and constitutional amendments. It is also the final authority on appeals. The 2006 International Convention will convene on September 11, 2006, in Cleveland, Ohio.

The International Convention is composed of delegates elected by secret ballot from and by the membership. Delegate representation is based on the number of members per local union. Our Local 827 membership requires eleven (11) Delegates to be present.

Members in good standing in the local union shall be given notice of the time, place and manner of making nominations and of the election of delegates. Once a member has, by secret ballot, been elected to serve as a delegate to the International Convention, it is the delegate's responsibility to participate in all convention activities, representing the membership of Local 827 at all times.

To enable full compliance with Federal Laws, the IBEW Constitution, and Local 827 Bylaws meetings have been scheduled for the nomination of Delegates to the International Convention. Normal Union business will also be conducted at the meetings. The information below is being provided as timely notification of the meetings. Please mark your calendars.

Nominations will be accepted from the floor. A second on the nomination is not required. If the nominee is not present, the member making the nomination must present a letter of intent, signed by the nominee, signifying acceptance of the nomination for a Delegate position. A member to be elected as a Delegate or Alternate must have at least twenty-four (24) months good standing in the local union immediately prior to nomination.

Upon adjournment of each meeting, names of nominees will be forwarded to Headquarters. Upon verification of each nominee's eligibility, and if there are more than eleven (11) nominees, the Headquarters Staff will prepare ballots. The names of all eligible nominees will be listed in alphabetical surname order. Voting will be conducted by secret mail ballot. Instructions will be included on the ballot. Ballots will be mailed on June 6, 2006 and must be received back by 9:00 am on June 22, 2006. Ballots will be picked up from the East Windsor Post Office at 9:00 am, June 23, 2006, and will be transported to Local 827 Headquarters, 263 Ward Street, East Windsor, NJ. The vote count shall take place beginning at 10:00 am at Headquarters. Candidates have a right to IBEW observers.

If you do not receive a ballot, you must contact your Chief Steward. The Chief Stewards will be the sole point of contact with Headquarters for the request of duplicate ballot or new ballots. Requests for duplicate or new ballots will not be accepted by Headquarters after 3:00 pm, June 19, 2006.

The eleven (11) candidates receiving the most votes will be declared elected. There are no run-off provisions required. Alternates, if necessary, will be determined by the next highest vote counts for any additional candidates beyond the eleven (11) elected.

Election procedures for Delegates to the International Convention are governed by the Labor-Management and Disclosure Act of 1959 as Amended (LMRDA). Section 401(g) of the Act prohibits the use of union or employer funds to promote the candidacy of any person. This prohibition applies to cash, facilities, equipment, vehicles, office supplies, etc. of Local 827 and any other union, and of any employer, whether or not they employ Local 827 members. No union or employer may contribute money or anything of value. The prohibition applies to direct expenditures as well as indirect expenditures including:

> Campaigning on time paid for by the union or employer
> Use of union/employer owned or leased equipment such as telephones, fax machines, copy machines
> Use of union/employer supplies such as stamps, paper, or envelopes
> Use of union employees to prepare campaign literature while on union time
> Use of the union letterhead
> Use of union/employer property or facilities
> Printing articles which support or criticize an individual's candidacy in a union newspaper or other publication
> Giving free services or special discounts to a candidate customer such as printing, photocopying, etc.

All candidates are encouraged to keep accurate records of campaign contributions and expenses so that any allegations of improper use of any union, or any employer funds can be resolved.

Federal law also provides that candidates must be treated equally regarding the opportunity to campaign and that all members may support the candidates of their choice without being subject to penalty, discipline, or reprisal of any kind.

Each candidate has the right to inspect but not copy, a list of members, once within thirty (30) days before the election. Contact Statewide Election Chairperson, Jason A. D'Errico through Headquarters if you wish to make arrangements.

Local 827 will honor any reasonable request to distribute campaign literature to members at the requestor's expense. Requests will be honored in the order received. Contact Statewide Election Chairperson, Jason A. D'Errico through Headquarters if you wish to do a mailing.

All candidates should act in a reasonable manner and raise any questions or concerns as soon as possible so that Election Officials have a chance to investigate and/or respond in a timely fashion. Any member who believes a protest of an election is warranted is urged to contact the Statewide Election Chairperson in writing within a few days after the ballots are counted. Further, protests of the election may be filed in writing with the International Vice President of the Third District within thirty (30) days following the election. The decision of the International Vice President shall conclude the processing of a protest within the IBEW. In the event the protesting member is not satisfied with the decision of the International Vice President, the member may submit his/her protest to the U.S. Department of Labor.

As the Statewide Election Chairperson I urge you to participate in this democratic process and cast the ballot for the candidates who you feel will best serve the interests of this Local at the International Convention.

Below are the time and locations for the February General Membership Meetings. A vote on the proposed Bylaw changes on restructuring from 6 units to 4 units will be taken at these meetings. As I reported after the membership survey, the membership overwhelmingly voted to restructure by a vote of 2,092 in favor of restructuring and 296 in opposition of restructuring. You must attend one of these meetings to be eligible to vote. We are at a major crossroad and tough decisions need to be made. Please attend your meeting and vote.
